Terms and Conditions of the Mur-Mürz Top Ski Pass tariff association

1. General information

The MUR-MÜRZ TOP SKI PASS TARIFF ASSOCIATION (henceforth Mur-Mürz Top Ski Pass) offers its services through the participating cable cars and other sales partners solely on the basis of these Terms and Conditions.  These Terms and Conditions apply to all services. The services purchased through the Mur-Mürz Top Ski Pass are non-transferable!

2. Applicability of the General Tariff and Transport Conditions

The general tariff and transport conditions of Mur-Mürz Top Skipass and the respective member companies of Mur-Mürz Top Skipass (henceforth referred to as member companies) apply.  These are available on the respective websites and are displayed on site.

3. Member companies

The customer’s contractual partners are solely the member companies of the Mur-Mürz Top Ski Pass. As the member companies of Mur-Mürz Top Ski Pass are independent legal entities, any liability or warranty for incidents arising from or during the operation and use of the cable car and lift facilities as well as the slopes and leisure facilities, shall be borne exclusively by the member company in whose area the incident occurred. The current member companies of the Mur-Mürz Top Ski Pass are listed at www.skiberge.at.

4. Subject matter of the contract

The subject matter of the contract is the sale of access authorisations for lift facilities to be stored on data carriers. Mur-Mürz Top Ski Pass may unilaterally change the service descriptions, provided that the respective change is reasonable for the customer because it is minor and objectively justified. Mur-Mürz Top Skipass will inform customers in writing of such changes to the service description. The cash register and access system developed by SKIDATA AG is used to process the sale and activation of access authorisations (Mur-Mürz Top Ski Pass) for the SKIDATA access control system available at the member companies in conjunction with electronic data carriers (KeyCards) via the Internet or other electronic media.

5. Period of validity

During the 2022/23 winter season, customers are entitled to use all cable cars and lifts operated by member companies during their respective opening hours.

The latest availability of services is made public daily at the respective ticket offices, on the electronic panorama boards, via the respective information channels and on the Internet.

6. COVID-19 measures

Compliance with any mandatory COVID-19 measures or other protective measures to contain a pandemic is the sole responsibility of the customer. If the customer is unable or unwilling to comply with such mandatory measures, they may be refused transport (information available at www.skiberge.at).

7. Liability/damage

Any malfunctions of a Mur-Mürz Top Ski Pass can only be processed and rectified immediately if the customer reports them to the nearest ticket office at the earliest opportunity. If the customer fails to do so, Mur-Mürz Top Skipass and its member companies are not liable for any resulting damages (ongoing limited usability of the Mur-Mürz Top Skipass, etc.). Compensation for defective data carriers is excluded if the customer obtains another access authorisation at the ticket office on site within a reasonable time necessary for verification. Lost or forgotten lift passes will not be replaced.

8. Privacy policy in line with the GDPR

Mur-Mürz Top Ski Pass and its member companies process the personal data of employees, partners, customers and suppliers for the purpose of conducting business activities and fulfilling associated legal and contractual requirements. Please refer to the privacy policies of the participating lift operators, which are published on their websites. When purchasing a product issued with a specific name, the cardholder’s personal data is processed for checking purposes to prevent card misuse and for the provision of customer service. This data is deleted once the purpose has been fulfilled, but no later than three years after the last customer contact. For the above-mentioned checking purposes, the cardholder’s personal data will be forwarded to Mur-Mürz Top Ski Pass and to those companies where the name-specific product is valid.
The customer has the option of creating data transmission via secure data connections (SSL) in their own area. At the very minimum, the participating companies will transmit any data necessary for payment processing via secure data lines. The customer expressly agrees to the transfer of the payment confirmation to the payment system and – after payment has been approved – to the debiting of the respective invoice amount using the direct debit authorisation procedure for the selected payment method. All companies involved in the booking process are subject to telecommunications secrecy and the confidentiality obligations of the Data Protection Act.

9. Information according to GDPR, art. 13 and 14, on “Photocompare”

Please note that for access control purposes, a reference photo of the lift pass holder will be taken when they first pass through a turnstile equipped with a camera. This reference photo will be compared by lift staff with the photos taken each time the lift pass holder passes through a turnstile equipped with a camera. The reference photo will be deleted immediately after the lift pass expires, and the other photos will be deleted no later than 30 minutes after each passage through a turnstile.
